These Terms & Conditions ("Terms") govern your use of the Sober Since mobile application (the "App") and sobersince.app (the "Website"). By using the App or Website, you agree to these Terms.
1. About Sober Since
Sober Since is a lifestyle tool for tracking an alcohol-free streak, related progress estimates, milestones, private trail notes, and previous climbs. The service is provided by Rohan Taneja, Berlin, Germany.
2. Not Medical Care
Sober Since is not a medical service, treatment program, diagnostic tool, crisis service, or substitute for professional advice. The App does not promise that you will stop drinking or remain alcohol-free.
Alcohol withdrawal can be dangerous. If you may be physically dependent on alcohol, seek advice from a qualified healthcare professional before stopping. If you are in immediate danger or experiencing a medical emergency, contact your local emergency services.
3. Eligibility
You must be at least 18 years old and legally able to enter into these Terms to use Sober Since.
4. Local Data and No Account
The App does not require a user account. Core progress, trail notes, and climb history are stored locally on your device. You are responsible for your device, backups, and access controls. Deleting the App, clearing its data, losing the device, or changing devices may result in permanent data loss.
We do not guarantee that locally stored data can be recovered, restored, or transferred. Features may change as the App develops.
5. Estimates
Money-saved, drinks-avoided, time, and milestone calculations are estimates based on information and assumptions entered into or used by the App. They are provided for personal reflection and may not be exact.
6. Purchases and Subscriptions
Some features may require a one-time purchase or automatically renewing subscription. Apple or Google processes payment, billing, cancellation, and refunds under the terms of the relevant store. RevenueCat helps us manage purchase entitlements but does not process your full payment-card information.
Prices, trial availability, subscription periods, and included features are shown before purchase and may vary by platform or region. You can manage or cancel subscriptions through your App Store or Google Play account.
7. Acceptable Use
You agree not to misuse, disrupt, reverse engineer, copy, resell, or unlawfully access the App or Website.
8. Intellectual Property
The App, Website, name, artwork, interface, and related content are owned by or licensed to Sober Since and are protected by applicable intellectual-property laws. These Terms grant you a limited, personal, non-transferable right to use the App and Website for their intended purpose.
9. Third-Party Services
The App and Website rely on services provided by Apple, Google, RevenueCat, Mixpanel, Ahrefs, Cloudflare, and other infrastructure providers. Their availability and processing are governed by their own terms and policies.
10. Availability and Changes
We may modify, suspend, or discontinue features or the service. We do not guarantee uninterrupted availability, compatibility with every device, or preservation of local data.
11. Disclaimer
To the extent permitted by law, the App and Website are provided "as is" and "as available" without warranties of any kind. Nothing in these Terms limits mandatory consumer rights that cannot legally be excluded.
12. Limitation of Liability
To the extent permitted by law, we are not liable for indirect, incidental, special, or consequential losses, loss of data, or decisions made based on App estimates. Our aggregate liability will not exceed the greater of the amount you paid us during the 12 months before the claim or EUR 10. Liability is not limited where applicable law prohibits limitation, including for intent, gross negligence, or injury to life, body, or health.
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, without depriving consumers of mandatory protections available in their country of residence. Where legally permitted, courts in Berlin, Germany have jurisdiction.
14. Changes to These Terms
We may update these Terms as the service or legal requirements change. The current version will be posted here with an updated date. If a material change requires consent, we will request it where required by law.
